    Non-Immigrants - All talk and no action?

    I have been a silent member of ImmigrationVoice.org, a group formed by and for Highly Skilled Non-Immigrants wishing to legally migrate to the US to lobby Congress for reforms. When I first heard about ImmigrationVoice on another immigration bulletin board, I was curious to find out what their agenda was. With an ambitious goal of reforming the immigration system to favor the Highly Skilled Immigrants and with a little over 200 members, I was one amongst the next 100 who hoped that this then small organization would make a difference and signed up. I am here on a H1B work visa and still have 3 years left. I know that this struggle has to start for me now for it would be too late.

    By now, the organization had grown to almost 3000 members and with a dedicated team of advisors and group members, they made a bang in the immigrant community last year by going on a PR spree and even rallied amendments through prominent pro-immigrant senators and lobbying firms to include/introduce amendments in the failed 2006 CIR bill, all through meagre finances (compared to other anti-immigrant groups) albeit rich with passion and hope.

    I consciously started donating not because I was hoping that something WILL happen, but atleast with the hope that I tried to make it happen and that I can proudly go down if it didn't. People have almost always benefited from the actions of a small group of highly motivated individuals who tried and tried and tried. Some succeeded but some failed. Those who led and won will make history. Those who followed and won will proudly remember the history. Those who refused to follow and still won will with guilt remember the history.

    Hope is the quintessential trait of a successful person. If I knew how to predict the future, I wouldn't be here. What is important is that behind hope there is always strength. Mahatma Gandhi once said that "Strength does not come from physical capacity. It comes from an indomitable will".

    Every non-immigrant has the indomitable will to succeed based on his/her definition of success. I had the indomitable will to fly 12,000 miles to a destination I had never been to, clutching a scholarship and hope. I had the indomitable will to persist after 9/11 to find a job. If I didn't I would have called it quits and returned back home. My friend almost got killed at a gas station. Why? He had the indomitable will to try to stand up on his own to pay his tuition and living expenses. There are several stories of sacrifices and will power that constantly amaze me even till this day. One guy worked at a meat packing plant to earn minimum wage while simultaneously studying for a triple major. The worst part of his story was that he comes from a strict indian family of orthodox brahmins who by tradition and religion consider all living beings sacred.

    When you hear these stories of how people have lived their lives to reach wherever they are, lobbying for a reform should be an easier task. Its not rocket science. Just like americans, we non-immigrants take our rights for granted. "We pay taxes. We pay Social Security. We pay Medicare. We pay state taxes. etc. etc." SO WHAT? You drive a car, get excellent health care, make enough money to buy your parents a house/car, parade yourself everytime as the rich successful lad who left the shores to the land of opportunity everytime you visit your motherland. At what cost?

    Sometimes, Charles Darwin's quotes come to my mind; Like this one - "It is not the strongest of the species that survives, nor the most intelligent that survives. It is the one that is the most adaptable to change."
    We, non-immigrants adapt ourselves to the utmost degree that we almost always end up trying to find the easy route in order for us to preserve our way of life in the name of adaptiveness.

    John Porter counters Charles darwin by saying-"People underestimate their capacity for change. There is never a right time to do a difficult thing. A leader's job is to help people have vision of their potential."

    In my humble opinion, that is exactly what ImmigrationVoice.org has been trying to do.

    Off late, it seems that a majority of the members seem to bring in their own agenda and rally behind their own agenda completely devoid of ImmigrationVoice.org's objectives. There was not one bulletin board thread which has never sidetracked from the topic of discussion. In the name of constructive criticism or the character of the devil's advocate, a small minority have caused confusion and resentment of the objectives of ImmigrationVoice.org. For those members, I suggest that you read the objectives of ImmigrationVoice.org and subscribe to them or look for another group with common objectives such as yours.

    I have always had the opinion that if you can't get it done, step aside and let someone else do it. Observe, encourage, argue with a discipline and respect like a professional, but don't leave. Every single ounce of hope is required to achieve ImmigrationVoice.org's goals. Its hard to convey emotions through words, but I do know that deep within every non-immigrant's heart, there is a passion for success, hard work, commitment and willpower. If not, we wouldn't be forcing the nation/world to take notice of us or atleast try doing so.

  • Another thought i had was...Before all of us june,july,august folks land up in the blackhole of FBI namechecks...Can we lobby for some kind of transparency?What in the world can make them take 4 yrs to check a persons name?Can they at least maintain a website that they update as and when a name check is completed...Please core and members,do something about this...something as effective as the campaign to accept july applicants!!while they are overhauling the system let them get it right all the way!!

  • I would not mind getting EAD few weeks late and prefered to have reciept notice recieved instead. I filed Jul 2nd at TSC and no news yet about Reciept, CC, EAD, AP. Most July 2 filer at NSC got their reciepts 2 weeks ago.
    There may be 1% chance of 485 being rejected and that is pretty scary. Easly NSC filers can atleast put their mind at rest for 485 acceptance.

    I agree with you . peace of mind is better than getting EAD 2 weeks early

    Yes, this is not a linear equation that illegals take American jobs and Amecans do not take menial jobs because of lower pay. If Americans were ever to take such jobs, and pays were higher, it would add to inflation, as beppenyc correctly points out. You have to be able to think strategically to understand this.

    Now this issue about fairness for the legal immigrants. Normal wait time for this process is 5 to 6 years, if you are lucky. Which means that lives of such people are on "hold." They can't be promoted, accept salary increases. This is "tacit" exploitation. 5 to 6 years is a long time in US where things are more dynamic. How unfair. Also, per the law any social security they contribute will never be credited back to them because they have to work for atleast 10 years, the work visa duration is six year. Skilled workers make reasonable salaries so this is a huge amount of money which thay might never see.

    Perceptions maybe far removed from reality. One of them is that immigrants will continue to bear injustice in US while globalization takes its toll on US competitiveness because of populist measures, that will hurt it in the long run.

    He says that Eb2 India will retrogress to 2003 or 2004.

    This is my opinion. TSC 485 processing time is July 17,2008. NSC 485 processing cut off date is July 28th, 2008. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.

    Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

    yes. there is a possibility of some retrogression for EB2 India/China in the comming bulletins. But that is just for few months and it might be a mild retrogression as long as there is horizontal fall outs of spill over visas.

  • I also don't think this is true. After you get your 3-year H1B extension beyound the 6-year limit and say your 485 gets denied while you are in 7th year, you can still stay and work for the rest of the 2 years on your H1B and use those 2 years to file for new LC etc.

    Gurus, please advise, with the slew of mistaken 485 denials this is an important point to clarify.

    He will have the H1 status until the expiry date. But only thing he may not be able to transfer H1 if there is no other case is pending.

    I received RFE on my I-131 application asking for all the I-94's that is being issued to me.

    I had been in and out of US many times and there's lot if I-94's involved and I don't anything with me except the latest. What options do I have?... Also couple of times during my earlier trip (initial visits in US), the AIR Line didn't even take the I-94 from my Passport which ultimately I lost.

    My Passport has all the entries indicating my Date in and Date out...

    Gurus - What do you advise on my case...

    Anybody's input are highly appreciated and I know we could somehow get the I-94 copies by requesting USCIS. (That is time consuming)... I have to respond in next five to ten days...

    What options do I have?...

    Your issue is that airline didn't took I-94 and that doesn't match with what uscis has. So be honest and give them whatever you have.

    just a guess, they must be pre-adjudicating - pending a visa number. So, looks like (again a guess), if they pre-adjudicate before the FP expiry date, then you are good, otherwise, they will ask you to go to FP again...

  • though I agree there is no grace period however practically USCIS has not been rigid about the dates. MOST of the employers do not inform USCIS about firing of H1b. During dot com bust, USCIS has 'unofficially' said that 15-20 days are good enough (again not as a policy decision but informally). It should be avoided, however it may not be always possible, and having few days gap should not be something on which you make life or death decision.

    We checked the records and find that since September 2006 (date of your joining) contribution has been in April 2009 for $25 as a one time contribution. After that there have been no contribution. Due to a one time $25, you had donor status for a month. We had given you donor status and access for more than a month until 19 July 2009 for you to renew your subscription. If you have contributed recently, contact us with the details.

    I had issues setting up recurring payments. I did setup one just now and let me know if it is drawing funds correctly.


    i-140 was approved on december 2006
    i-485 was filed on 6/2007

    between december 2006 and september 2007 company got worst and worst also real estate market. Some people kept saying it will get better. It never got better.
